1. About TEKILA

TEKILA is an independent body jewelry brand operated by TEKILA Portugal, Lda., with registered office at Rua António Alves de Azevedo, 8, Agualva-Cacém, Portugal, NIPC 311 490 980, registered with the Portuguese Commercial Registry under the same number.

These Terms of Service govern purchases made through tekila.pt.

By placing an order through our online store, you agree to these Terms, together with the policies and information made available on our website.

2. Products

TEKILA offers body jewelry and related products as described on each product page.

We make every reasonable effort to ensure that product descriptions, dimensions, materials, finishes, photographs and prices are accurate.

Because anodized titanium is produced through an electrochemical process, slight variations in colour or tone may occur between pieces. Colours may also appear differently depending on screen settings and lighting.

Customers are responsible for checking the gauge, diameter, bar length and other dimensions before ordering. If you are unsure which size is appropriate for your piercing, we recommend consulting a professional piercer.

3. Prices

Prices are displayed in euros (€) and include applicable taxes where required.

Shipping costs, when applicable, are shown before the order is completed.

The final amount payable is displayed at checkout before payment is confirmed.

4. Orders

Submitting an order confirms your intention to purchase the selected products at the price and under the conditions displayed at checkout.

After an order is successfully placed, you will receive an order confirmation.

All orders are subject to product availability and successful payment processing.

If an item becomes unavailable after an order has been placed, or if we are unable to fulfil the order for another legitimate reason, we will contact you and refund any amount paid for the affected item or order.

You may request cancellation before dispatch where possible. This does not affect any statutory consumer rights.

5. Payment

Available payment methods are displayed at checkout and may vary depending on the customer's location, device or payment provider.

Payments are processed through the payment services made available by Shopify and/or the relevant payment provider.

TEKILA does not control the approval or refusal of transactions by third-party payment providers.

6. Shipping

Orders are prepared and shipped from Portugal.

For Portugal, standard delivery costs €2.95, with free standard delivery on orders of €35 or more. Estimated delivery time is 3–5 business days.

For eligible European Union destinations, tracked delivery costs €7.90, with free tracked delivery on orders of €75 or more. Estimated delivery time is 5–8 business days.

Cyprus is currently excluded from our European Union shipping destinations.

Delivery estimates may be affected by carriers or circumstances outside TEKILA's reasonable control.

7. Right of Withdrawal and Returns

For eligible distance purchases, consumers may exercise their statutory right of withdrawal within 14 days, in accordance with applicable consumer law.

After notifying TEKILA of the decision to withdraw, eligible goods must be returned without undue delay and within the legally applicable period.

8. Hygiene and Piercing Jewelry

For health and hygiene reasons, piercing jewelry supplied in sealed hygiene packaging cannot be returned under the right of withdrawal once the hygiene seal has been opened.

To remain eligible for a return under the right of withdrawal, jewelry must remain unused, unworn and, where applicable, in its original sealed hygiene packaging.

This hygiene restriction does not affect the customer's statutory rights where a product is defective, damaged, incorrect or otherwise not in conformity with the contract.

9. Defective or Non-Conforming Products

TEKILA is responsible for lack of conformity of goods in accordance with applicable Portuguese and European consumer law.

For new movable goods sold to consumers, Portuguese law generally provides a three-year period of responsibility for lack of conformity from delivery.

Where a product is defective, damaged, incorrect or otherwise non-conforming, customers should contact TEKILA through our Contact page.

The customer's statutory rights, including the remedies available under applicable consumer law, are not limited by these Terms or by our hygiene-return restrictions.

10. Piercing Safety and Professional Advice

Body jewelry must be selected according to the anatomy, placement and condition of each piercing.

Information provided by TEKILA regarding sizes, placements and jewelry types is intended as general product guidance and does not replace professional piercing or medical advice.

For fresh, healing, irritated or problematic piercings, customers should seek guidance from an appropriately qualified professional.

11. Intellectual Property

Unless otherwise stated, the TEKILA name, branding, graphics, photographs, product imagery, written content, guides, design elements and other original content available through tekila.pt are owned by or licensed to TEKILA.

Such content may not be reproduced, distributed, commercially exploited or used without prior authorization, except where permitted by law.

12. Personal Data and Cookies

Personal data is processed in accordance with our Privacy Policy and applicable data-protection legislation.

Information regarding cookies and consent preferences is available through the Cookie preferences link on our website.

13. Alternative Dispute Resolution

Consumers may have the right to use an Alternative Dispute Resolution (ADR/RAL) entity for consumer disputes.

The competent entities and the information required under Portuguese consumer law are provided in our Legal Notice.

The use of alternative dispute-resolution mechanisms does not restrict any rights available to consumers under applicable law.

14. Applicable Law

These Terms are governed by Portuguese law, without prejudice to any mandatory consumer protections applicable to consumers residing in another country of the European Union.

Nothing in these Terms is intended to exclude or limit rights that cannot legally be excluded or limited.

15. Changes to These Terms

TEKILA may update these Terms when necessary to reflect changes to the store, services or applicable legal requirements.

The version applicable to an order is the version made available at the time the order is placed.
